Senate Bill 1780C introduced permanent legislation to authorize settlement and title agents and real estate attorneys to close real estate and mortgage transactions using RON commencing June 30, 2022. However, the Governor of New York signed a subsequent executive law on February 24, 2022, before the new law could take effect.

Note that this subsequent legislation delayed the effective date of remote online notarization provisions from Jun 30, 2022, to Jan 31, 2023. Notaries have to be physically located within the state at the time of the notarization.

The legislation defines RON as the act of performing any notarial act, such as administering an oath, while a principal isn’t in the physical presence of the notary public at the time of the performance of the notarial act. New York requires all notaries to register with the Secretary of State’s office prior to performing a remote or electronic notarization.

Remote notarization can be completed by electronic signature. Also, the notary public must be physically present in New York at the time of the notarization. However, the principal or signer can be out of state. The principal and notary must be able to communicate with each other in real time.

New York electronic notaries have to take these additional compliance and registration steps to perform RON:

• Use only vendors that comply with New York standards and regulations
• Use a suitable network that permits location detection when completing the electronic notarial act
• Provide a brief description of the technology that the notary will use to attach their signature to the electronic record
