No, an eviction notice does not have to be notarized to be legally binding. While the laws may vary slightly from state to state, an eviction notice only requires the signature of the landlord or landlord’s agent.

What is an eviction notice?

An eviction notice is a legally binding document a landlord provides to their tenant, informing them that they must either comply with the rental or lease agreement or vacate the property. Typically, an eviction notice offers tenants a determined number of days to pay rent or fix any damages in question. 

If that period ends without resolution, the landlord may file an eviction lawsuit against the tenant.

Causes and types of eviction notice

  • Pay Rent or Quit Notice: This happens when a landlord provides notice to tenants who have not paid their rent. Depending on the state upon receipt, the tenant has a few days to pay their due balance or move out.
  • Cure or Quit Notice: These are served when a tenant has violated a term or condition of the rental agreement, such as a no-pet clause or repeated noise violations. This type of notice provides a set amount of time for the tenant to “cure” the violation or move out. 
  • Unconditional Quit Notice: This type of notice simply informs the tenant that they will have to move out, as well as when. This type of notice does not give any option to pay or correct a violation in order to stay. These types of notices typically have laws that stipulate how and when they may be served, depending on the state they are served in.
